Terms of Service

These Terms of Service ("Terms") govern your use of the Nouriva mobile application ("the App") developed and operated by Zane Benton ("I", "me", "my"). By downloading or using Nouriva, you agree to these Terms.

1. Acceptance of Terms

By accessing or using the App, you confirm that you are at least 13 years old and agree to be bound by these Terms. If you do not agree, do not use the App.

2. Description of Service

Nouriva is an AI-powered nutrition tracking application that provides food logging, barcode scanning, photo-based food recognition, recipe generation, intermittent fasting tracking, grocery list management, and personalized nutrition insights. The App integrates with Apple HealthKit and uses AI services to deliver its features.

3. Account Registration

Some features require an account. You agree to provide accurate information and keep your credentials secure. You are responsible for all activity under your account. You may delete your account at any time from within the App.

4. Subscriptions & Payments

• Nouriva offers a free tier and a Premium subscription ($4.99/month or $29.99/year).
• Premium subscriptions include a free trial period. You will not be charged until the trial expires.
• Subscriptions are billed through Apple's App Store and are subject to Apple's terms.
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period.
• You can manage or cancel subscriptions in your device's Settings → Apple ID → Subscriptions.
• Refunds are handled by Apple per their refund policy.

5. AI-Generated Content

Nouriva uses artificial intelligence (Anthropic's Claude) to provide food recognition, nutrition estimates, recipe suggestions, and chat-based guidance. You acknowledge that:

• AI-generated nutrition data is an estimate and may not be perfectly accurate.
• AI-generated recipes and suggestions are for informational purposes and may not account for all individual health conditions.
• The App is not a substitute for professional medical or dietary advice. Always consult a qualified healthcare provider for medical nutrition decisions.

6. Not Medical Advice

Nouriva provides general nutrition information and tracking tools. Nothing in the App constitutes medical advice, diagnosis, or treatment. Calorie targets, macro recommendations, fasting guidance, and AI insights are estimates based on general formulas and user-provided data. I am not a licensed healthcare provider. Use the App at your own discretion and consult a professional for health concerns.

7. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose.
• Attempt to reverse-engineer, decompile, or extract source code from the App.
• Abuse, exploit, or overload the App's AI features or backend services.
• Upload harmful, offensive, or illegal content through photos or chat.
• Share your account credentials with others or create multiple accounts to circumvent usage limits.

8. Intellectual Property

The App, its design, code, branding, and content are owned by Zane Benton. You may not copy, modify, distribute, or create derivative works from the App without written permission. Content you create (food logs, recipes, lists) remains yours.

9. Data & Privacy

Your use of the App is also governed by the Privacy Policy, which describes how your data is collected, used, and protected.

10. Availability & Changes

I strive to keep Nouriva available and functional, but I do not guarantee uninterrupted access. I may update, modify, or discontinue features at any time. Material changes to these Terms will be communicated via the App or this page.

11. Limitation of Liability

To the maximum extent permitted by law, Nouriva and Zane Benton shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. This includes, but is not limited to, damages related to inaccurate nutrition data, health outcomes, or loss of data. Total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

12. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, accuracy, or non-infringement.

13. Indemnification

You agree to indemnify and hold harmless Zane Benton from any claims, damages, or expenses arising from your misuse of the App or violation of these Terms.

14. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles.

15. Termination

I reserve the right to suspend or terminate your access to the App if you violate these Terms. You may stop using the App at any time by deleting it and your account.
